Legal Senior Citizen Age in California

On the civil side, the primary source of legal authority to prosecute older adults abuse claims in California is the Seniors and Dependent Adults Civil Protection Act (the «Act»). The law was enacted in 1982 and was one of the first comprehensive civil laws on elder abuse in the country. Its purpose was (and is) to require reporting of suspected elder abuse and to provide adequate civil remedies for older adults who are victims of abuse and victimization, as criminal prosecution for these matters was rare at the time of enactment. A qualified lawyer who has experience with the previous law can too often use this law, as well as precedents in other cases, to resolve cases amicably because the risk of punishment is so great. In the legal world, one of the most pressing issues related to an aging population is elder abuse, whether physical, financial or emotional. California has long been at the forefront of passing aggressive laws to combat elder abuse, which the state recognizes as a particularly vulnerable population. This is done through a combination of criminal and civil law, some of the most important of which are explained below. (h) A residential complex may be considered a seniors` residential facility for the purposes of this section even if, on January 1, 1997, the complex does not meet the definition of a seniors` housing facility in clause (b), if the development meets that definition for each dwelling occupied after January 1, 1997 and if the complex has already been covered by that definition. and did not meet the definition due to one of the following reasons: Essentially, a private organization, such as a social club or retail store, can set its own rules for determining the status of «seniors.» Often, age 55 is the age at which a person is eligible for a seniors` discount. Upon written request by the senior or an authorized person acting on the senior`s behalf, the owner, board of directors or board of directors has the discretion to allow an approved health care resident to remain for a period of more than 90 days from the date on which the senior`s absence began if it is determined that the senior will return within a maximum of 90 days.

Federal and state governments can also adopt their own rules. For example, some government services are available to seniors once a person turns 55. Special requirements apply to seniors renewing their driver`s licence. These requirements are intended to prevent people with poor vision, perceptual impairments or slow reflexes from driving. Each state sets its own requirements, which may include an eye screening or driving tests for people of a certain age. For example, seniors in California may not only have their licenses revoked because of their age, but those who are 70 or older may meet certain requirements. Older adults with physical or mental illnesses may need to undergo a new examination or hearing that includes a written medical history from their doctor. written, vision and driving tests; and evidence that supports their ability to continue driving safely.

The age varies greatly from state to state, for example, age is 65 in Arizona and 80 in Florida. Conditions such as arthritis, high blood pressure, or hearing loss can make you feel like you`ve crossed the senior`s line. «A person with multiple age-related medical conditions may feel older simply because of the number and type of medications or medical devices they use,» says Cindy Moore, co-founder and managing partner of Seniority, an online directory of resources for seniors in the Birmingham, Alabama area. «It`s hard to feel young when you`re equipped with a walker or hearing aid.» Also, feeling tired or ready to go to bed at 9 p.m. may indicate that you`re getting older. California`s «elder abuse» laws cover a variety of crimes and harmful activities against older adults. These issues are addressed in the California Penal Code 368 PC on elder abuse and include acts such as physical abuse, emotional abuse, which causes psychological suffering, neglect and vulnerability, and financial abuse. (4) «seniors` housing facility» means an apartment complex of more than 20 units developed as a community of the elderly by its developer and designated by a local government agency as a community of the elderly or designated in its administrative documents as a community of the elderly within the meaning of section 4150 or qualified as a community of the elderly under the Federal Act Amending the fair housing;  1 as amended.  Any seniors` residence required to obtain a public report under article 11010 of the Commercial and Professional Code and to submit its request for a public report after July 1, 2001 must have received a public report as a residential facility for the elderly under article 11010.05 of the Commercial and Professional Code.
