The following topics are divided into two sections that provide details on each of the two FLK assessments. Assessment objectives are set for each area, followed by the knowledge of the law and practice that candidates must apply to answer the questions. The main legal principles and rules that a candidate must apply are listed below by area of expertise. A candidate should be able to apply these fundamental legal principles and rules appropriately and effectively at the required level of a competent lawyer newly qualified in practice to realistic client-related and ethical issues and situations. Each question with the best answer is followed by five possible answers. Candidates must check only one answer for each question. SQE1 consists of two functional assessments of legal knowledge (FLK) with 180 multiple-choice questions. The depth and breadth of knowledge of English and Welsh law required of candidates is that of practical legal knowledge. This means that applicants must apply their legal knowledge to demonstrate the skills required at the level of a newly qualified barrister from England and Wales. Occasionally, in legal practice, for example, a cause name or statutory provision is the term normally used to describe a legal principle or area of law, rule or procedural step (e.g., Rylands v. Fletcher, CPP Part 36, Section 25 Notice). In these circumstances, applicants must be aware of and able to use these case names, legal provisions, etc.
In all other cases, applicants are not required to remember the names of specific cases or to cite legal or regulatory authorities. These easy-to-use learning guides are published and updated regularly to help you successfully prepare for SQE1 exams. They provide in-depth knowledge and understanding of fundamental legal principles and rules and bring law and practice to life with examples of scenarios based on clients` realistic problems. The classification method used for this design is Single Best Classification. This means that an element is assigned to the classification that is considered the main subject of this question. This does not mean that the questions are discrete and fit neatly into all categories, since, for example, an item may require knowledge of «dispute resolution» and «contract» in order for a candidate to answer them correctly. As such, a draft may describe an assessment as containing 20% of the questions of a particular classification, but the application of the knowledge of that classification would be required to answer more than 20% of the questions in the document. Applicants are not required to demonstrate knowledge of foreign law, foreign assets or foreign taxes. SQE1 FLK reviews are a closed book. Assessment questions are intended to test the application of fundamental legal principles that can be expected of a newly qualified solicitor in England and Wales without reference to books and notes.
